Singur case (Singur verdict): CPM govt’s acquisition of land for Tata Motors was illegal, says SC. Big setback for Tata’s & CPM’s but a big win for Mamata Banerjee & TMC plus poor farmers.


Singur-West Bengal is another victory of Mamata and TMC as, Hon. Supreme Court says “Singur land acquisition deal for Tata-Nano project was a farce”. It means Mamata Banerjee was right by saying it was a forceful accusation of land by Buddhadeb Bhattacharjee and Tatas.

The acquisition of ‘fertile multi-crop agricultural land’ by the West Bengal govt in 2006 for Tata Motor’s Nano car project was against the 1894 Land Acquisition Act, says the apex court.

The Supreme Court on Wednesday quashed the acquisition of 997 acres of land by the CPM-led West Bengal government in 2006 for Tata Motors’ Nano car project. This announcement comes as a big set-back for Tata's & CPM’s.

A bench comprising justices V. Gopala Gowda and Arun Mishra said that the acquisition was illegal and void, and failed to meet the requirements under the Land Acquisition Act 1894.



The apex court’s judgement comes as a shot in the arm for Trinamool Congress government in West Bengal, which had brought a law to return the land to the owners.

The Apex court directed the West Bengal government to take possession of the land and distribute it to the land owners within 12 weeks.

It also announced that the farmer's who got compensation from the government will not return it because they were deprived of their livelihood for the last ten years.

The SC also said that Tata had bypassed the rules while acquiring the land.

The bench noted that the entire exercise was done by "bulldozing the law" as the then Cabinet suo motu cleared the allocation of the land identified by the automobile major which was the task of the government of the day.

The bench said it was a farcical exercise through which the land was allocated and it was a "legal mala fide".

Background:  

You may recall that in May 2006, the then CPM government led by Buddhadeb Bhattacharyya announced that Tata would locate their 'Rs 1 lakh' car project — Nano project — in Singur for which some 997 acres of land would be allocated. The land would be acquired for the Tatas by a state industry promotion agency.

Mamata Banerjee then had kicked up a storm and protested the acquisition of the land by industry giants Tata. The farmers, whose land was being acquired by the company, were taking their compensation cheques, however to stop agitation led by the Trinamool Congress, CPM & Tata’s turned violent.

Tata soon started the construction of the plant and amid the agitation released their model Nano car. However, Mamata Banerjee relentlessly protested the acquisition of the land while firmly asserting that her party was not anti-industry and the 400 acres of land belonging to the 'unwilling farmers' should be returned to them. Her "Save Farmland" movement was supported by various environmental activists and intellectuals.

Mamata Banerjee was on 26days hunger strike in protest. Even then Bengal’s Governor wants to settle the issue but arrogant Buddhadeb & Ratan Tata thoughts they are above the law.

Supreme Court of India now justified Mamata Banerjee’s Singur Movement (Singoor Andolon) was right and killer Buddhadeb, whose goons grabbed the land for their master Tatas and killed many including brutal rape and killing of Tapasi Malik was wrong.

We strongly believe that now Ratan Tata & Buddhadeb Bhattacharjee should seek unconditional apology from public, farmers & martyr’s family.

Acche Din (Good Days) a cruel joke by the BJP & Narendra Modi as India de-grown in Acche Din above all NDA Govt is destroying Federal structure of India & not cooperating with State Governments. Bengal CM, Mamata Banerjee rightly takes on centre by saying “Centre destroying federalism & Modi taking credit for all”.


Accusing the Center of destroying federalism and pushing the states towards destruction, West Bengal Chief Minister Mamata Banerjee ridiculed Prime Minister Narendra Modi for taking credit for development carried out by her government.

Addressing a mammoth rally in the city last month, the Trinamool Congress supremo also accused the Modi government of unleashing central agencies like the Central Bureau of Investigation and the Enforcement Department (ED) that, she said, led to over 80,000 industrialists leaving the country.

“The Center is interfering in everything. It is destroying the federal structure. We too are an elected government and the Constitution has specified both the Center and the state’s roles. But they are interfering in our working and constantly threatening us,” Banerje said.

Actually BJP ruled Center govt is neglecting opposition ruled states and worst sufferer is TMC leaded West Bengal as per their political Vendetta.

The completion of  5 ears of TMC Govt and the Elections post that had given TMC &Mamata Banerjee a thumping majority against a crude hypocritical shabby alliance between two Non Existent Political Parties in West Bengal. Till writing this blog one party is struggling to achieve its identity after meetings after meeting condemning old brigade ushering new force (when no one knows) and another who is loosing Municipality one after another. In between this melee the Saffron Brigade also come into foray with its Cow Counting Campaign, internal fighting and the Central Govt Threats.

India Inc is enduring its worst earnings drawdown of the last 20 years, burdened by weak growth, high interest costs with excessive private sector debt and over-capitalised balance sheets, says a report.

According to global financial services major Morgan Stanley, the current drawdown in earnings has broken the 2001-02 and 2008-09 levels, and the recovery in earnings would be delayed by about four quarters. The report also noted that global situation is an additional drag on Indian earnings. "India has been in its worst earnings drawdown since we have the data (from 1996)," Morgan Stanley said.

Done with the Planning Commission a new ultra Digital Commission is commissioned named NitiAyog. Understandable the earlier one was formed by Congress so obvious now they will have another new one in a new Bottle, may after next election we may have another of this sort.

This NitiAyog has shot letters informing to curtail Central Aid in their fund projects and increased States contribution, seemingly thinking that all States are like cash rich like Vijay Malya and others.

Reeling under debt courtesy Left Front / Congress repeated request to have a monetorium has been intentionally rejected. One may recall that it is not new Punjab was given this option since 1946 it was given a monetorium and later the loan was waived off because a special financial situation in Punjab which now exists in Bengal. 

If you compare the two our situation is worse , moreover Indian Govt gave 10 billion US Dollars to IMF for debt reconstruction for Greece but sadly can’t give 50 % of that to debt stressed states of Punjab, Kerala .

Sometimes it’s funny to think if Bengal is out of India or not ? You have money to give to Greece but not Bengal.

There has been a lot of talk about increase of Central Govt Aid from earlier Govt. True it has but also there is a flip side of it look at the schemes that has been stopped or decreased like the 13th& 14th Finance Commission grants.  100 days work is trimmed down. So you have a carrot in front and you also have Cow to nibble at it. Thus whatever is said needs to be verified and clarified. Schemes like ICDS BRGF needs to be continued by the State and thus loan needs to be taken. The difference is Left took loans to feed their cadre base and we take loans for Developments. Developments of Hospitals, Roads , Schools Colleges etc. Oppostion shouts about huge loan taken by TMC during its 5 years of tenure compared to their 34 years of MISRULE is that WB Govt has taken 86000 Core out of which they had to pay 76000 core as debt which is courtesy Left Front, so ideally its 6000 Cores loan by WB Govt. 

Thus what Didi (Mamata Banerjee) has said is correct the Central Govt now wants to find out ways & means to throttle the Bengal Govt by not helping with grants curtling funds as they could not do anything with Region or Cows in the last Elections. But we in Bengal know how to fight and it’s our Didi who will lead us SHE will take us through.
